How we handle the information you give us.

This agreement explains what happens to the information you submit through the Waymarker AI Opportunity Audit, the basis on which we process it, and the terms that apply to that processing. Please read it before you submit the form.

1. Who we are

In this agreement, "Waymarker", "we", "us" and "our" refer to the Waymarker business operating from Australia. "You" refers to the individual completing the audit and, where you complete it on behalf of an organisation, that organisation. By submitting the audit form you confirm you have read, understood and agree to this agreement.

2. What we collect

Through the audit we collect the information you choose to provide, which may include:

You decide what to enter. Please do not submit sensitive personal information, health information, financial account details, passwords, or confidential information belonging to third parties. The free-text fields are for describing your business operations, not for confidential data.

3. Why we collect it and your consent

By submitting the form, you consent to Waymarker collecting, storing and processing the information you provide for the following purposes:

You may withdraw your consent and ask us to stop contacting you at any time by replying to any email from us or by emailing admin@waymarker.com.au.

4. How it is processed and stored

When you submit the form, your answers are sent to a secure processing function that records your submission in our internal customer records system and uses an AI model to generate your report. Your report is then emailed to the address you provided. We store your submission so we can deliver your report, respond to you, and maintain an internal record of leads and enquiries.

5. Third party service providers

To deliver this service we rely on reputable third party providers, which may include hosting, AI model, email delivery and records management providers. Your information is transmitted to and handled by these providers solely to deliver the service described above, and some of them may process or store data outside Australia.

Important. These third party providers operate their own systems under their own terms and security controls, which are outside our control. To the maximum extent permitted by law, Waymarker is not liable for any act, omission, outage, error, breach or loss caused by, or occurring within, any third party provider or any other party we do not control. Your use of this service is on the basis that you accept this allocation of responsibility.

6. Security

We take the security of your information seriously and apply measures that are reasonable and appropriate for a service of this kind. These include transmitting data over encrypted connections, keeping access credentials confidential, limiting who can access submissions, and using multi-factor authentication and access controls on the accounts we use to handle your data.

No method of transmission or storage over the internet can be guaranteed to be completely secure. While we take reasonable steps to protect your information, we cannot and do not warrant that it will be absolutely secure, and you acknowledge that you provide your information on that understanding.

7. Your responsibilities and warranties

By submitting the form you represent and warrant that:

The report we generate is general information and commentary based on the answers you give. It is not professional, financial, legal or operational advice, and you remain solely responsible for any decision you make based on it.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law:

You agree that you assume responsibility for your decision to provide information through this service and for your use of the report, and you release Waymarker from claims to the extent set out above.

9. Retention, access and deletion

We keep your submission for as long as is reasonably necessary for the purposes described in this agreement, and then delete or de-identify it. You may ask us at any time to confirm what we hold about you, to correct it, or to delete it, by emailing admin@waymarker.com.au. We will action reasonable requests within a reasonable time.

10. Your non-excludable rights

Nothing in this agreement excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that applies to you under the Australian Consumer Law or other applicable law and that cannot lawfully be excluded or limited. Where a term of this agreement would otherwise be unlawful or unenforceable, it is to be read down to the extent necessary, or severed, so that the rest of the agreement continues to apply. Your privacy is handled in line with our obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

11. Changes and contact

We may update this agreement from time to time. The version published here at the time you submit the form is the version that applies to that submission. This agreement is governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
